14. James Barton II was born on 3 Oct 1734 in Maryland.8

General Notes: It is assumed, because Temperance (Rollo) Barton remarried to Wm Robinson after the death of husband, James, that the deeds involving Robinson's Chance and a James Barton were transacted with Robinson's stepson James son of James Barton and Temperance Rollo. More proof needed here.

If this can be established then James Barton, son of James & Temperance was still living in Harford County in 1796 when Robinson's Chance was sold to Robert Amoss in a judgment against James Barton. However, since this was a sale under a writ, James did not sign deed making is conceivable that the sale occurred as a result of James' death. Hence this James may be the one whose estate was administered by Archibald Robinson and Thomas Barton on 11/24/1795 (Estate file 657 per "Heirs and Legatees of Harford County, MD - 1774-1802" by Peden)

This Indenture made this twentieth day of September one thousand seven hundred and ninety six. Between William Osborn Esquire former Sheriff of Harford County of the one part and Robert Amoss of said County of the other part Whereas a Writ of Fieri Facias did issue out of Harfor County Court on a judgement obtained by said Robert Amoss against James Barton directed to the said Sheriff by virtue of which said Writ the sheriff did seize and take into possession on Tract or parcel of lease Hold Land called Robinsons Chance being 92 acres which said Tract or parcel of Land were by virtue of a Venditioni Exponas sold by the said sheriff to the said Robert Amoss who was the highest bidder for the same. Know this Indenture Witnesseth that the said William Osborn for and in consideration of the premises as also for and in consideration of the sum of five shillings current money to him in hand paid by the said Robert Amoss. Hath given,granted, bargained and sold, Aliened, endorsed(?) and confirmed by these presents do give, grant, bargain and sell, alien, endorse(?), confirm unto the said Robert Amoss his heirs and assigns forever all the right and interest that the said James Barton had to the aforesaid tract or parcel of land lying in Harford Count on the Drafts of the Little Falls of Gunpowder together with all Rights, members, privileges, houses, ways, orchards, rents, profits, emoluments and appurtenances to the same belonging or in any ways appertaining to have and to hold the premises with the appurtenances to the said Robert Amoss his heirs and assigns forever all the right and interest that the said James Barton had to the same and the said William Osborn for himself his heirs, executors, administrators and assigns do covenant and agree to and with the said Robert Amoss his heirs and assigns to make suffer convey or execute any farther conveyance or assurance for the more effectual conveying the premises such as the said Robert Amoss his heirs or assigns or either of them shall or may hereafter reasonably ask or demand to be at the proper costs and charges of the said Robert Amoss his heirs or assigns in Witness whereof he hath hereunto set his hand and affixed his seal the day and year above written

James Barton Little Contestable Manner


This Indenture made this third day of August in the year Eighteen hundred and one between Jesse Jarrett of Harford County of the one part and James Barton of John of said county of the other part. Witnesseth that the said Jesse Jarrett for and in consideration of the sum of ninety five pounds current money by him in hand paid before the ensealing and delivery of these presents the receipt whereof the said Jesse Jarrett doth hereby acknowledge and therewith fully satisfyed and paid hath given, granted, bargained and sold, aliened, enforced(?) and confirmed unto the said James Barton his heirs and assigns forever all that part of two tracts of land the one called Amosses & Myers puzzle and the other called Little Contestable manner lying in the following meets and bound Viz.. Beginning at a bounded Spanish Oak the original beginning of Contestable Manner Number Two and running thence south twenty four degrees past one hundred and sixty seven perches, south seventy three degrees east forty six perches untill it intersects Carter's Addition their bounding on that land reversely south forty four perches then running and bounding on the Original tract called Amosses & Myers Pussle North eighty six degrees west one hundred and twenty one perches then bounding on the division line between Smithsons and Jarretts North eighty eight degrees west thirty nine perches untill it intersects the original tract called Amosses & Myers Pussle then running & bounding on that land north thirty two degrees east forty four perches to the end therof and thence with a straight line to the beginning containing ninety eight acres of land more or less together with all rights profits benefits priviledges and appurtenances thereunto belonging or in anywise appertaining to have and to hold the said part of a tract and premises with every the appurtenances unto him the said James Barton his heirs and assigns forever from all persons claiming from by or under him the said Jesse Jarrett his executors or administrators in witness whereof the said Jesse Jarrett hath hereunto set his hand and seal the day and year above written.

Thomas Ayres Little Contestable Manner

This indenture made this twenty seventh day of January in the year eighteen hundred and two between James Barton of Harford County and State of Maryland of the one part and Thomas Ayres of the County and State of aforesaid of the other part. Witnesseth that the said James Barton for the consideration of the sum of one hundred and ten pounds five shillings current money to him in hand paid by the said Thomas Ayres the receipt whereof he the said James Barton doth hereby acknowledge hath given granted bargained sold aliened conveyed and confirmed and by these presents doth give grant bargain sell alien convey and confirm unto the said Thomas Ayres his heirs and assigns forever all that part of two tracts of land lying in the count aforesaid one called Ammosses and Myers's puzzle and the other called little Contestable manner contained in the following meets and bounds to wit beginning at a bounded spanish oak the original beginning of Contestable manner Number Two and running thence south twenty four degrees east one hundred and sixty seven perches south seventy three degrees east forty six perches untill it intersects Carters addition thence bounding on that land reversly south forty four perches then running and bounding on the original tract called Amosses and Myers's Puzzle north eighty six degrees west one hundred and twenty one perches then bounding on the division line between Smithson's and Jarretts north eighty eight degrees west thirty nine perches untill it intersects the original tract called Amosses and Myers's Puzzle then running and bounding on that land north thirty two degrees east forty four perches to the end thereof and thence with a straight line to the beginning containing ninety eight acres more or less agreeable to a deed made by Jesse Jarrett to the said James Barton baring date the thirtieth day of August in the year eighteen hundred and one to have and to hold the aforesaid land and premises with all the appurtenances thereunto belonging unto him the said Thomas Ayres his heirs and assigns forever. In witness whereof the said James Barton hath hereunto set his hand and seal the day and year first above written.

John C Bond, Sheriff Contestable Manor No 2

This indenture made this fourteenth day of Febry in the year of our Lord eighteen hundred and four between John Churchman Bond, Esq High Sheriff of Harford County of the one part and Thomas Ayres Senior of Harford County and the State of Maryland of the other part. Witnesseth that whereas on the twenty seventh day of April in the year of our Lord eighteen hundred and three the State of Maryland writ of Vendilioni Exponas did issue out of Harford County Court stating whereas at a county court of the State of Maryland begun and held for Harford County at the Courthouse of same County on the third monday in August in the year of our Lord one thousand seven hundred and ninety nine a certain Aquila Hall assinee of Abraham Jarrett by judgement of the said court recovered against James Barton late of Harford County Yeoman as well the sum of thirty seven pounds five shillings and eight pence current money and four hundred and twenty three pound of tobacco for his damages which he had sustained as well by reason of the detention of that debt as for his costs and charges by him about his suit in that behalf exposed whereof the said James Barton is convict as appears to us upon record and whereas also on the eleventh day of April in the year of our Lord one thousand eight hundred and one command was given to the said Sheriff that of the goods and chattels land and tenements of the said James Barton in his Bailiwick being he should cause to be made and levied the debt damages costs and charges aforesaid and that he should have those sums before the said County Court to be held at the Court House in the County aforesaid on the third monday of August in the year of our Lord one thousand eight hundred and one the said Sheriff made return thereof to the said Court that by virtue of the said writ to him directed for that purpose he had taken one field of corn one hundred and fifty bushels, one ditto, twenty five bushels, other on the same, one hundred and twenty acres of land being part of contestable Manor No. 2 and part of Resurvey on Amoss and Myers Pussel the goods and chattels lands and tenements of the said James Barton in your Bailiwick being to satisfy unto the said Aquila Hall the debt damages costs and charges aforesaid in the said writ mentioned which said goods and chattels lands and tenements remained in the hands of said Sheriff unsold for the want of buyers so that the debt damages cost and charges aforesaid he could not have as by the said writ he was commanded therefore commanded said Sheriff that the said goods and chattels lands and tenements so as aforesaid taken he should expose to sale and the money therefrom arising he should have before the Justices of Harford County Court at the Court House in the County aforesaid on the third monday in August then next to render to the said Aquila Hall for his debt damages costs and charges aforesaid and also one hundred and fifty three pounds of Tobacco additional costs and so forth and that the said Sheriff should have then and there the said writ whereupon the said Sheriff in pursuance of said command did on the thirtieth day of April eighteen hundred and three advertise at the Court House door and sundry other public places in Harford County that the aforesaid lands and tenements to wit one hundred and twenty acres of land being and lying over Deer Creek near Rangers Mill being part of contestable Manor No. 2 and part of resurvey on Amoss and Myers Puzzle the property of James Barton would be exposed to public sale at the Court Houses in Bell Air on saturday the seventh day of May then next on which said seventh day of May no purchasers appearing the sale was postponed untill the seventeenth day of the same month on which daid seventeenth day of May in the year of our Lord eighteen hundred and three the aforesaid several tracts or parcels of land was exposed to public sale and Thomas Ayres Senior became the highest bidder and purchased thereof by bidding there for the sum of fifty seven pounds ten shillings and three pence three farthings therefore this indenture witnesseth that the said John Churchman Bond Esquire High Sheriff of Harford County as well for and in consideration of the premises as the aforesaid sum of fifty seven pounds ten shillings and three pence three farthings to him in hand paid by the said Thomas Ayres the receipt whereof the said John Churchman Bond doth hereby acknowledge hath given granted bargained sold and conveyed and by these presents doth give grant bargain sell and convey unto the said Thomas Ayres all the right title interest propety claim and demand whatsoever either in Law or Equity of him the said James Barton of in and to the two Tracts or parcels of land aforesaid the one being part of Contestable Manor No. 2 the other part of Amoss and Myers Puzzle to have and to hold the said two tracts or parcels of land unto him the said Thomas Ayres his heirs and assigns to the only proper use and behoof of him the said Thomas Ayres his heirs and assigns forever in testimony whereof I have hereunto set my hand and seal the day and year first above written.

Be it remembered that on the 13th day of August one thousand eight hundred and one came Jesse Jarrett party to the within deed and acknowledged the same to be his act and deed and the land & premises therein mentioned to be the right title and estate of the within named James Barton his heirs and assigns forever and at the same time came Alazanna Jarrett wife of the aforesaid Jesse Jarrett and acknowledged here release of Dower in the aforesaid bargained and sold land and premises unto the aforesaid James Barton his heirs and assigns agreeably in such cases made and provided.

James Barton Amosses & Myers Puzzle
to and
Thomas Ayres Little Contestable Manner

This indenture made this twenty seventh day of January in the year eighteen hundred and two between James Barton of Harford County and State of Maryland of the one part and Thomas Ayres of the County and State of aforesaid of the other part. Witnesseth that the said James Barton for the consideration of the sum of one hundred and ten pounds five shillings current money to him in hand paid by the said Thomas Ayres the receipt whereof he the said James Barton doth hereby acknowledge hath given granted bargained sold aliened conveyed and confirmed and by these presents doth give grant bargain sell alien convey and confirm unto the said Thomas Ayres his heirs and assigns forever all that part of two tracts of land lying in the count aforesaid one called Ammosses and Myers's puzzle and the other called little Contestable manner contained in the following meets and bounds to wit beginning at a bounded spanish oak the original beginning of Contestable manner Number Two and running thence south twenty four degrees east one hundred and sixty seven perches south seventy three degrees east forty six perches untill it intersects Carters addition thence bounding on that land reversly south forty four perches then running and bounding on the original tract called Amosses and Myers's Puzzle north eighty six degrees west one hundred and twenty one perches then bounding on the division line between Smithson's and Jarretts north eighty eight degrees west thirty nine perches untill it intersects the original tract called Amosses and Myers's Puzzle then running and bounding on that land north thirty two degrees east forty four perches to the end thereof and thence with a straight line to the beginning containing ninety eight acres more or less agreeable to a deed made by Jesse Jarrett to the said James Barton baring date the thirtieth day of August in the year eighteen hundred and one to have and to hold the aforesaid land and premises with all the appurtenances thereunto belonging unto him the said Thomas Ayres his heirs and assigns forever. In witness whereof the said James Barton hath hereunto set his hand and seal the day and year first above written.

This indenture made this fourteenth day of Febry in the year of our Lord eighteen hundred and four between John Churchman Bond, Esq High Sheriff of Harford County of the one part and Thomas Ayres Senior of Harford County and the State of Maryland of the other part. Witnesseth that whereas on the twenty seventh day of April in the year of our Lord eighteen hundred and three the State of Maryland writ of Vendilioni Exponas did issue out of Harford County Court stating whereas at a county court of the State of Maryland begun and held for Harford County at the Courthouse of same County on the third monday in August in the year of our Lord one thousand seven hundred and ninety nine a certain Aquila Hall assinee of Abraham Jarrett by judgement of the said court recovered against James Barton late of Harford County Yeoman as well the sum of thirty seven pounds five shillings and eight pence current money and four hundred and twenty three pound of tobacco for his damages which he had sustained as well by reason of the detention of that debt as for his costs and charges by him about his suit in that behalf exposed whereof the said James Barton is convict as appears to us upon record and whereas also on the eleventh day of April in the year of our Lord one thousand eight hundred and one command was given to the said Sheriff that of the goods and chattels land and tenements of the said James Barton in his Bailiwick being he should cause to be made and levied the debt damages costs and charges aforesaid and that he should have those sums before the said County Court to be held at the Court House in the County aforesaid on the third monday of August in the year of our Lord one thousand eight hundred and one the said Sheriff made return thereof to the said Court that by virtue of the said writ to him directed for that purpose he had taken one field of corn one hundred and fifty bushels, one ditto, twenty five bushels, other on the same, one hundred and twenty acres of land being part of contestable Manor No. 2 and part of Resurvey on Amoss and Myers Pussel the goods and chattels lands and tenements of the said James Barton in your Bailiwick being to satisfy unto the said Aquila Hall the debt damages costs and charges aforesaid in the said writ mentioned which said goods and chattels lands and tenements remained in the hands of said Sheriff unsold for the want of buyers so that the debt damages cost and charges aforesaid he could not have as by the said writ he was commanded therefore commanded said Sheriff that the said goods and chattels lands and tenements so as aforesaid taken he should expose to sale and the money therefrom arising he should have before the Justices of Harford County Court at the Court House in the County aforesaid on the third monday in August then next to render to the said Aquila Hall for his debt damages costs and charges aforesaid and also one hundred and fifty three pounds of Tobacco additional costs and so forth and that the said Sheriff should have then and there the said writ whereupon the said Sheriff in pursuance of said command did on the thirtieth day of April eighteen hundred and three advertise at the Court House door and sundry other public places in Harford County that the aforesaid lands and tenements to wit one hundred and twenty acres of land being and lying over Deer Creek near Rangers Mill being part of contestable Manor No. 2 and part of resurvey on Amoss and Myers Puzzle the property of James Barton would be exposed to public sale at the Court Houses in Bell Air on saturday the seventh day of May then next on which said seventh day of May no purchasers appearing the sale was postponed untill the seventeenth day of the same month on which daid seventeenth day of May in the year of our Lord eighteen hundred and three the aforesaid several tracts or parcels of land was exposed to public sale and Thomas Ayres Senior became the highest bidder and purchased thereof by bidding there for the sum of fifty seven pounds ten shillings and three pence three farthings therefore this indenture witnesseth that the said John Churchman Bond Esquire High Sheriff of Harford County as well for and in consideration of the premises as the aforesaid sum of fifty seven pounds ten shillings and three pence three farthings to him in hand paid by the said Thomas Ayres the receipt whereof the said John Churchman Bond doth hereby acknowledge hath given granted bargained sold and conveyed and by these presents doth give grant bargain sell and convey unto the said Thomas Ayres all the right title interest propety claim and demand whatsoever either in Law or Equity of him the said James Barton of in and to the two Tracts or parcels of land aforesaid the one being part of Contestable Manor No. 2 the other part of Amoss and Myers Puzzle to have and to hold the said two tracts or parcels of land unto him the said Thomas Ayres his heirs and assigns to the only proper use and behoof of him the said Thomas Ayres his heirs and assigns forever in testimony whereof I have hereunto set my hand and seal the day and year first above written.

In the 1800 census, he was over 45 years of age and his wife was between 26 and 45. He had in his household three males under age 10, two between 10 and 16, and two females under age 10. His son Henry was named in Thomas Horn's will.

General Notes: Thomas Horn Jr., called Senior after the death of his father in
1792, was born around 1745, possibly in Johnston County, North
Carolina. Part of that county became Orange County in 1752. He was
named in his father's will and was residing in Orange County, North
Carolina in 1790 and in 1800. The 1800 census shows he was over 45 at
that time, and had a family of seven children, two sons and five
daughters. Thus far, only two have been identified. He was evidently
the Thomas Horne shown in the Orange County census of 1810. The name
of Thomas Horn, Jr. or 2nd appears in the deeds of Orange County from
1791 until 1823, at which time he had disposed of his land and may
have followed his sons, James and Joshua, to Tennessee. It is not
known where he died, possibly in North Carolina or Tennessee. He may
also have moved to Missouri in 1838.
