WILL OF JAMES BARTON - 1734

October the 20th, 1734
IN THE NAME OF GOD AMEN, I JAMES BARTON of Baltimore County in the Province of Maryland Planter being weak of body but of perfect and sound memory thanks be to God for the same do appoint and make this my last Will and Testament in manner following that is to say Viz

I give and devise unto my Son James Barton forty five acres of Land on which I now live running with and adjoining to the land of John Norris which he now lives on.

Next I give and devise to my Daughter Phillis Barton all my right Title and Interest in that Tract or parcel of land called BARTON'S CHANCE.

Next I give and devise to my two Brothers Thomas Barton and John Barton, Ninety Acres of Land being the remaining part of the Land on which I live to be equally divided between them.

Next I desire that my Just Debts may be paid and that the rest of my Personal Estate may be divided between my Wife and my Son and my Daughter according as the Law directs. Lastly I appoint my loving Wife Temperance Barton to be the Executrix of this my last Will and Testament.

At the foot of the aforegoing Will was the following probate thus written:

February the 19th 1734 Then came Archibald Rollo, Daniel Maccomas and Peter Carroll and made Oath on the Holy Evangelists of Almighty God that they saw the Testator James Barton sign the foregoing Will and heard him publish and declare the same to be his last Will and Testament and that at the time of his so doing he was to the best of their apprehension of sound and disposing mind and memory and that they subscribed their respective names as Witnesses to the said Will in the presence of the said Testator and at his requiest whcih oaths were taken in the presence of the said Archibald Rollo the father to the said Testators widow and Grandfather to James Barton heir at Law chich same Archibald Rollo did not object to the probate of the said Will.

James married Temperance Rollo on 8 Sep 1730 in Baltimore Co., MD.7 Temperance was born on 9 Aug 1713 in Balt. Co., MD 4 and died after Jul 1747 in Baltimore Co., MD.2

General Notes: Listed as Temperance Robinson, daughter of Archibald Rollo in father's will dated July or August 1747, leaving her 100 a. Turkey Hills and 40 a. Archibald's Addition (Baltimore County Families, by Barnes).

In 1750, William Robinson "of Gunpowder" was owner of 100 a. Turkey Hills, 49 a. Archibald's Addition and 25 a. Barton's Chance

WILL OF JOHN BARTON, SR - 1777

In the name of God amen I John Barton Senr of Baltimore County and Province of Maryland being weak and low but of sound sence and memory and calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make ordain and constitute this as my last will and testament this fourth day of January in the year of our Lord on thousand seven hundred & seventy three...

The worldly goods that it hath pleased the Lord to bless me with I give bequeath and bestow in the manner and form as followeth...

Item I give and bequeath to my well beloved wife Ann Barton all my whole estate after paying the legacies hereafter mentioned to her during her life or widowhood.

Item I give and bequeath unto my son John Barton all that part of the land I now living (sic) on beginning at the lower corner of my land next to Robert Bishops quarter or Plantation on Miladie's manner (sic, My Ladies Manor) and running with the Great Road till it intersects Daniel Pocock's land and with said Pocock's land till it intersects the Great run called by Elliotts Run and with said Run till it intersects the great Road and with the Great Road till it intersects the corner of the fence belonging the Plantation which he now lives on then with a straight line through the field from said corner to the spring branch by Morgans hog pen and from thence with a straight line to the outside of the manner and from that place to the beginning be it more or less to him & his heirs during the term of the Lease...

Item I give and bequeath all the remaining part of my land which I now claim unto my sons William Barton & James Barton to be equally divided between them after my wife's decease...

Item I give and bequeath unto my daughter Elizabeth Barton one horse to the value of fifteen pounds and also one side saddle which she now rides and also one feather bed & furniture and also one cow and calf, four ewes & lambs and also forty shillings worth of new pewter...

Item I give and bequeath unto my son William Barton one horse and saddle also one bed of furniture also one cow and calf...

Item I give and bequeath unto my son James Barton one horse and saddle also one bed & furniture also one cow and Calf...

Item I give and bequeath unto my daughter Alisanna Barton one horse to the value of fifteen pounds and also a good side saddle and also one feather bed & furniture and also one cow and calf and also four ewes and lambs and also forty shillings worth of new pewter also one Negro girl about three months old named Lintey to her and her heirs forever with the increase of the said Negro girl

Item I give & bequeath unto my daughters Jemima Pocock and Kesiah Clark each of them one pair of silver buckles and one gold ring at twenty five shillings value each...

And also I give unto my son John one pair of silver buckles at twenty five shillings price...

And all the residue or remaining part of my estate to be equally divided amongst all my children after my wifes decease and in case my wife should marry again before the legacies bequeathed my daughters should be paid or they arrive to age my will & desire is the legacies should be paid to them at their day of Marriage and also every other legacy bequeathed my children in case of her marrying all my children that is of age to immediately enjoy their legacies...

This indenture made the fifth day of November in the year of our Lord one thousand seven hundred and forty one, between Thomas Preston of Baltimore Cournty in the Province of Maryland and Elizabeth his wife of the one part and John Barton of the same county and province of the other part; Witnesseth that said Thomas Preston for and in consideration of the sum of one thoursand five hundred pounds of good found merchantables ---- to him is paid before the ensealing and delivery of these presents the receipt whereof the said Thomas Preston and Elizabeth his wife do hereby acknowledge and themselves (?) ---- will fully satisfied ----- and paid, do by these presents ------ and discharge the said John Barton his heirs and assigns forever, hath given granted bargained sold aliened ------ and confirmed and by these presents to give grant bargain, sell, alien ---- and confirm unto the said John Barton his heirs and assigns forever one hundred thirty five acres of land ---- or ---- being apart and parcell of a tract of land called Expectation containing four hundred and ---- acres lying in the af'd county of Baltimore on the south side of Wintow Runn (?) near the side thereof at the foot of Adtoney(?) hill and running ---- with the said run south twenty three degrees past three hundred and twenty perches to abounded Walnutt thence south fourteen degrees past eighty perches to abounded Road Oak, standing near the af'd Run, thence west twenty four degrees, south one hundred and ten perches to abounded Red Oak, thence north north west four hundred and five perches to abounded Hickory and from there to the beginning tree laid out for and containing in all four hundred and ---- more or less and which one hundred and five acres of said (being part and parcell of af'd was formerly sold by James Preston the deceased brother of the said Thomas to Thomas Barton also deceased father of the said John, together will all homes and houses, ---- buildings, Guardians, orchards ---- and ---- together all deeds scripts writts ---- or Battouts (?) touching or ---- the said one hundred and thirty five acres of land by these presents bargained and sold. Tho Have and to hold the said one hundred and thirty five acres of land more or less with all its rights ---- and jurisdiction, privilidges and appurtenances to the same belonging or in any way appurtaining to have the said John Barton his heirs and assigns ---- and the said Thomas Preston and Elizabeth his wife do covenant and agree to with the said John Barton that the af'd one hundred and thirty five acres of land and premises as well against themsleves, their heirs and assigns forever shall and will warrant to the said John Barton his heirs and assigns forever defendby these presents against any person or persons that shall lawfully lay any claim to title thereunto from by or under us or any of our heirs or assigns and that the said land hereby bargained and sold is free and clear of all encumbrances whatsoever excepting only those costs and doweries that shall thereafter become due to the Lord Proprietary his heirs and --- and Lastly that this said Thomas Preston and Elizabeth his wife his heirs and assigns do covenant and agree to and with the said John Barton his heirs and assigns that ---- the said Thomas Preston and Elizabeth his wife shall from time to time and at all time forever hereafter at the reasonable request and at the cost and charges in the --- of him the said John Barton his heirs and assigns make do acknowl'd go suffer and execute or cause to be made done acknowledged suffered and executed all and every such further and other act or acts thing, device or assurance in the law as the said John Barton his heirs or assigns or his or their council learned in the law shall reasonably devise advise or require for the further better and more ---- ---- the af'd land and premises. Memorandum that on the --- day of November 1741 came the within Thomas Preston one of the partys to the within deed and acknowledged the within mentioned one hundred thirty five acres of land and promised thereunto belonging to the within named John Barton his heirs and assigns forever in common form. ----- same day came the within named Elizabeth wife of the said Thomas Preston and being examined out of the hearing of her husband acknowledged her right of dower to the within mentioned land and premises voluntary without any fear or threat of her said husband according to law before us two of his Lordships Justices.

This indenture made seventh day of march one thousand seven hundred & forty three between John Barton of Baltimore County of the one part and Thomas Elliot of the same county of the other part witnesseth that the said John for the consideration of four thousand pounds Tobacco to him in hand paid the receipt whereof he doth hereby acknowledge hath bargained & sold unto said Thomas all that part of a tract of Land called "Expectation" (?) formerly belonging to his father, Thos Barton deceased containing one hundred thirty five acres being part of same tract of land belonging unto Peter Carroll & John Norriss to have & to hold of said land & premises with all improvements thereon & appurtenances thereto belonging to the said Thos his heirs & assigns for ever & the said John doth covenant and agree to giveth the said Thomas his heirs & assigns that the said John is _____ of the said land in his demand as of _____ said John for himself his heirs Est & Adm doth further covenant and agree to giveth the said Thomas his heirs and assigns that the land & premises shall be to him & them well & _____ warranted & defended against the said John & his heirs & assigns claiming any right to the said land under him & them the rents and services hereafter to grow due. Payable to the Lord Prop'ry his heirs & therefrom half an acre of land fo a burying place where the said Thomas Barton deceased is buryed & dwelling hous where the said Thomas now lives in during the life of Abigall Barton only excepted & lastly the said John Shall & will at any time hereafter make & duly execute any other or further conveyance or assurance of the premisses wherein wife of the said John shall acknowledge here right of dower in witness whereof the said John hath hereunto set his hand & seal the day and year above written.

Be It Remembered (?) that on the 7th day of March 1743 came John Barton party to within deed before two of his Lordships Justices of Balt County & acknowledged the within land & premisses to be the right title and interest of the within Thos Elliot his heirs & assigns for ever according to the true intent & meaning of the within deed acknowledged before.. =lease= This Indenture made the twelfth day of April in the year of our Lord one thousand seven hundred & forty four, Thos Brerewood Senr of Balt County in the province of Maryland Esq of the one part and John Barton of the Coty and Province --- of the other part. Witnesseth that the said Thos Brerewood for and in consideration of the yearly rents covenants clauses articles conditions and agreements hereinafter mentioned on the part and behalf of the said John Barton his heirs, executors, administrators or assigns hath --- granted and farm lett and by these presents doth reconvey rent to farm lett unto the said Jno Barton his heirs, executors, administrators or assigns all that tract of land now surveyed and laid out by ---- J W Bond beginning at the corner of the land laid out for Stephen Byerly on the south south west line (?) of the manner and running parallel to the sd. line north north east two hundred forty five perches then west north west thirty two perches then south sixty two degrees west one hundred and two to the corner of Fuller(?) Addition and with Fuller(?) Addition south forty degrees east sixty perches then south southwest one hundred forty perches then with a straight line to the beginning containing and laid out for seventy five (or two) acres and one quarter of an acre land together with all improvements, easements, wayes (?) inclosements and profits(?) --- end belonging or appurtaining to the here described premises or any part therof situated and being in the manner of the said Tos Brerewood ---- a tract of land called My Lord Baltimore's Gift or more commonly My Lady's Manor, to have and to hold all and singular the here described premises unto the Jno Barton his heirs, executors, administrators or assigns from the day and date hereof and during the terms of the natural life of him the said John Barton being about the age of twenty nine years and also the natural life of Ann Barton his wife being about the age of twenty years and also the natural life of Jamima Barton her daughter being about the age of sixteen months ----- paying therefore the yearly of four hundred thirty three and one half pounds of Tobo every year on or before the twenty fifth day of december. Every ---- the terms of the above said ---- the first years rent to begin and commence the twenty fifth day of december next ensuing the date hereof upon the severall articles & conditions clauses and agreements following. Viz....

First the four hundred thirty three and a half pds of good merchantable leaf tobacca to be packt in good order and well condition in a good and sufficient Hogshead with as much more tobacco if sent --- the said Thos Brerewood his heirs, executors, administrators or assigns every year as shall make the said Hogshead full Eight Hundred clear of wood and to roled (?) and ferried to the nearest landing to the manner in good order and condition and to be safely housed, the said Hogshead nails packing and rolling or carriage all at the charge and expense of the said Jno Barton his heirs, executors, administrators or assigns every year as shall make the said Hogshead full Eight Hundred or shall be delivered to an Estate ---- or house upon the manner if required by the said Thos Brerewood his heirs, executors, administrators or assigns.

Secondly the said Jno Barton his heirs, executors, administrators or assigns has hereby full power and authority to cutt down such wood or timber as shall be necessary to build a dwelling upon the said tract of land and all other convenient --- and for fences and all other lawfull inclosurements (?) for the said plantation but not to sell, carry off or dispose of without leave first obtained in writing from the said Thos Brerewood his heirs, executors, administrators or assigns.


Thirdly all mines and ---- of what nature soever are reserved to the sole use and benefit of the said Thos Brerewood his heirs, executors, administrators or assigns.

Fourthly the bounds of the said tract of land to be kept justly statued and marked and not to exceed the just --- at the charge and expense of the said jno Barton his heirs, executors, administrators or assigns.

Fifthly due proof to be made of the several ---- above mentioned at the charge and expense of the said Jno Barton his heirs, executors, administrators or assigns --- whom required by the said Thos Brerewood his heirs, executors, administrators or assigns.

Sixthly all buildings and other improvements that are or shall ---- upon the premises to be put and kept in good and sufficient repair at all times but especially upon six months notice given at any time by the said Thos Brerewood his heirs, executors, administrators or assigns which said notice shall be delivered in writing or affixt upon the said plantation by the said Thomas Brerewood his heirs, executors, administrators or assigns.

Seventhly if the said Jno Barton his heirs, executors, administrators or assigns or any of them shall hereafter be so minded to part with sell or dispose of all or any part of the premises granted by this lease he or they shall give the first refusall thereof to the said Thos Brerewood his heirs, executors, administrators or assigns which upon --- then the said Jno Barton his heirs, executors, administrators or assigns after the discharge of all arrears of rent and all other debts due or --- that are or may become due or owing any manner of --- whatsoever to the said Thos Brerewood his heirs, executors, administrators or assigns has power to dispose of the same to any good tennant under the same clauses and conditions as above and during the remainder of the term above.

Eightly the said Jno Barton his heirs, executors, administrators or assigns is to behave himself peaceably and neighbourly to all the rest of the tennants on the manner and not to injure them in their possession, --- estates or creatures --- of way whatsoever.

The omission or transgression of any of the above articles conditions clauses and agreements is hereby agreed declared and ---- a forfeiture of this lease and the said Thos Brerewood his heirs, executors, administrators or assigns have hereby full power and authority to re-enter the premises and dispose of the same as fully as if this lease had never been made otherwise the said doth for himself Thos Brerewood his heirs, executors, administrators or assigns and every of their by these presents covenant promise grant and agree to and with the said Jno Barton his heirs, executors, administrators or assigns every of them for and under the yearly rents covenants clauses articles conditions and agreements --- fully paid and performed as afd shall and peaceably have hold and enjoy all and singular the here described premises and every part thereof without any trouble --- mollestation or deniall of him the said Thos Brerewood his heirs, executors, administrators or assigns or any other ----- person or persons whatsoever claiming or that shall or may claim by from or under him, them or every of them or any other. In witness whereof the parties to these presents have interchangeably set their hands and seals the day and year above written.

Be it remembered that on the application of John Barton of Baltimore County, license is hereby granted to the said John Barton to sell assign and set over unto Asshell Hitchcock of the said County his executors, administrators and assigns under the terms, conditions and processes of the original lease all that tract of land called Barton's Harbour containing by estimation fifty acres lying in the said county and being part of the land there reserved for his Lordship's use he the said John Barton having now paid to me for the use of the right honourable the Lord Proprietary the sum of five shillings sterling for this Licence, witness my hand and seal this eleventh day of March Anno Dom 1747.

This Indenture made this fifth day of April in the year of our Lord one thousand seven hundred and forty eight between John Barton of Baltimore County in the Province of Maryland of the one part and Ashael Hitchcock of the same county of the other part. Now as by Indenture of Lease bearing date the first day of September in the year one thousand seven hundred and forty two made between Benjamin Tasker Esq (agent and Receiver Generall for the Right Honourable the Lord Proprietary on behalf of his Lordship of the one part and the said John Barton of the other part he the said Benjamin Tasker for the consideration therin mentioned did devise, grant and to Farmlett(?) unto the said John Barton all that tract or parcel (of) called Barton's Harbour for fifty acres being part of the lands reserved in the said county for his Lordship's use to be had and holden unto the said John Barton his executors, administrators and assigns from the first day of September one thousand seven hundred and forty two for and during the term of ninety nine years then next to come and fully to be compleat and ended at and under the yearly rent of five shillings sterling and under sundry conditions covenants restrictions clauses agreements and reserves as in and by the said lease may more fully appear. This indenture witnesseth that the said John Barton by virtue of a licence by him obtained on the eleventh day of March 1747 for and in consideration of the sum of five thousand pounds of Tobacco to him paid by the said Asshael Hitchcock the receipt whereof the said John Barton doth hereby acknowledge and the said John Barton hath granted, bargained, sold assigned and set over and by these presents doth grant, bargain, sell, assign and set over unto the said Ashael Hitchcock his executors, administrators and assigns all that said tract of land called Barton's Harbour and premises and every part and parcel therof with the appurtenances together with the said lease to have and to hold the said tract of land and premises above mentioned and hereby assigned with appurtenances unto the said Ashael Hitchock his executors administrators and assigns for and during all the residue of the term of ninety nine years which is yet to come and the said John Barton for himself his heirs executors and administrators doth -------- and grant to and with the said Ashael Hitchcock his executors, adm and assigns in manner and form following. That is to say that the said assigned lease is now in full force and effect and that the said John Barton hath good right to grant and assign the said tract of land and premises with the appurtenances unto the said Ashael Hitchcock his executores, administrators and assigns in manner aforesaid also that he the said Ashael Hitchcock his executors, administrators and assigns shall and may under the rent conditions covenants and restrictions and clauses agreements and promises in the said lease contained for and during all the rest and residue of the said term of ninety nine years which is yet to come, peaceabley enter into have, hold, occupy possess the said tract of land and premises hereby assigned with the appurtenances without the interruption or denial of him the said John Barton or any other person or persons whosoever lawfully claiming the same or any part thereof ------ of said tract of land and premises with the appurtenances ----- from all manner of encumbrances whatsoever the yearly rents to become due from henceforth ---- the severall conditions, covenants, restrictions, provisions and agreements contained in the said lease only excepted. Lastly that he the said John Barton his heirs, executors, and adminstrators warrant and defend the said tract of land and premises with ---- appurtenances unto the said Ashael Hitchcock his executors, administrators and assigns for and during the residue of the said term to come from all person or persons whatsoever excepting as before expressed. On the fifth day of April 1748 cam John Barton and acknowledged the within instrument of writing to be his act and deed and that land and premises therin mentioned to be the right, title and estate of the within named Ashael Hitchcock his executors, admin and assigns for and during the term within mentioned before us.

The following is a transcription of the will of John Barton, Sr as taken from microfilm at the Maryland State Archives which had been taken from Harford County Records at Bel Air Courthouse record number AJ/2/37.

WILL OF JOHN BARTON, SR - 1777

In the name of God amen I John Barton Senr of Baltimore County and Province of Maryland being weak and low but of sound sence and memory and calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make ordain and constitute this as my last will and testament this fourth day of January in the year of our Lord on thousand seven hundred & seventy three...

The worldly goods that it hath pleased the Lord to bless me with I give bequeath and bestow in the manner and form as followeth...

Item I give and bequeath to my well beloved wife Ann Barton all my whole estate after paying the legacies hereafter mentioned to her during her life or widowhood.

Item I give and bequeath unto my son John Barton all that part of the land I now living (sic) on beginning at the lower corner of my land next to Robert Bishops quarter or Plantation on Miladie's manner (sic, My Ladies Manor) and running with the Great Road till it intersects Daniel Pocock's land and with said Pocock's land till it intersects the Great run called by Elliotts Run and with said Run till it intersects the great Road and with the Great Road till it intersects the corner of the fence belonging the Plantation which he now lives on then with a straight line through the field from said corner to the spring branch by Morgans hog pen and from thence with a straight line to the outside of the manner and from that place to the beginning be it more or less to him & his heirs during the term of the Lease...

Item I give and bequeath all the remaining part of my land which I now claim unto my sons William Barton & James Barton to be equally divided between them after my wife's decease...

Item I give and bequeath unto my daughter Elizabeth Barton one horse to the value of fifteen pounds and also one side saddle which she now rides and also one feather bed & furniture and also one cow and calf, four ewes & lambs and also forty shillings worth of new pewter...

Item I give and bequeath unto my son William Barton one horse and saddle also one bed of furniture also one cow and calf...

Item I give and bequeath unto my son James Barton one horse and saddle also one bed & furniture also one cow and Calf...

Item I give and bequeath unto my daughter Alisanna Barton one horse to the value of fifteen pounds and also a good side saddle and also one feather bed & furniture and also one cow and calf and also four ewes and lambs and also forty shillings worth of new pewter also one Negro girl about three months old named Lintey to her and her heirs forever with the increase of the said Negro girl

Item I give & bequeath unto my daughters Jemima Pocock and Kesiah Clark each of them one pair of silver buckles and one gold ring at twenty five shillings value each...

John married Ann Hitchcock on 23 May 1738 in Baltimore Co., MD.10 Ann was born about 1722 in Baltimore Co., MD 23 and died before 1 May 1792 in Harford Co., MD.24

General Notes: Estate file 97, for John Barton, father of Alisanna, lists next of kin as Alice Norris and James Barton. This suggests that Alisanna married a Norris. (See Heirs & Legatees)

7. Ann Barton was born on 8 Oct 1720 in Baltimore Co., MD 13 and died before 1792 in Orange County, NC.14

General Notes: Husband listed as William Horn in Balt. Co Families by Robt Barnes, but listed as Thomas Horn in Gift from Abigail Barton recorded in Harford Co in 1743 (see notes for Abigail)

Ann married Thomas Horn before Nov 1743 in Baltimore Co., MD. Thomas was born about 1725 in Pennsylvania(?) 39 and died in May 1792 in Orange Co, North Carolina, about age 67.39

General Notes: "Baltimore County Families" by Barnes lists husband of Ann Barton as William Horn.

Tradition has it that the Horn's were 'Holland Dutch'; however, it is believed that they may have actually been of German descent and may have been Quakers. Thomas Horn Sr. is believed to have been born in Pennsylvania. In the Baltimore County, Maryland tax list for the year 1737, he is shown living north of the Gunpowder River in the household of William Cathren. That may mean his father had died by that time. Records show Thomas purchased 275 acres in Orange County, North Carolina in 1755.

His will was made in Orange County, signed on April 6, 1792 and proved in the May term that year. Found in Will Book B, page 183, it reads as follows:

'In the name of God, Amen: I Thomas Horn, Senior, of the County of Orange, being sick and weak in body but of perfect mind and memory thanks be given unto God, calling unto mind the mortality of my body and knowing it is appointed for all men once to die, do make and ordain this my last will and Testament, that is to say principally and first of all, I give and recommend my soul to the hands of Almighty God that gave it and my body is recommended to the Earth to be buried in a decent Christian burial at the discretion of my Executors, mothing doubting but at the General Resurrection I shall receive the same again by the mighty power of God and as touching such worldy estate in which it has pleased God to bless me in this life, I give, and demise and dispose of the same in the following manner and form. 'First, I give young Henry Horn, son of Joshua Horn, my bed and furniture, not to be used until of age and besides 20 pounds of lawful money and to my son Thomas Horn, Junior, bed and furniture and house furniture and 20 pounds lawful money of said state, and besides to young Henry Horn I give and bequeath to him a cow and calf, and to Nelly Horn, daughter of James Horn, I give and bequeath to her, 5 pounds, and her mother Margery 5 pounds, which is all the rest of my estate that remains after these legacys are settled. 'To my son Thomas Horn, Junior, I give and bequeath to him whatever remains and I do hereby disallow, revoke and disannul all and every other former Testament, Wills and Executors by me in any wise before named, willed and bequeathed rattifying and confirming this and no other to be my last Will and Testament. In witness whereof hereunto set my hand and seal this 6th day of April in the year of our Lord 1792.'

Thomas' wife, Ann, apparently died before 1792, or else she would have been
mentioned in his will.
